McCabe Pleading in Detainee Abuse Case

Press Release – SO2 McCabe, the main accused in the Navy SEALs detainee abuse case, has formally notified the government of his intent to plead “Not Guilty” to all charges and is requesting a trial by a panel of military members, including enlisted members, commonly known as a jury.

Arraignment without Evidence

On December 7, 2009, SO2 McCabe’s civilian military attorney, Neal A. Puckett, reserved the entry of pleas and selection of forum until a later date, as is customary at military arraignments.  Unusual about this case was the fact that as of the date of the arraignment, the defense had not yet been provided with the evidence against Petty Officer McCabe.  Mr. Puckett was told that the evidence was undergoing a security review before being released to the three Navy SEALs charged in this case.

Notice of Plea

The formal notice of pleas and selection of a jury trial were submitted to meet a court-ordered deadline of Friday, December 11, 2009, even though prosecutors have not yet provided the evidence to the Law Firm of Puckett and Faraj.

Court-Martial Schedule

The courts-martial of the three Navy SEALs are set to begin sometime in January, 2010.  SO2 McCabe and his defense team are preparing for his court-martial, currently scheduled to begin on January 19, 2010.  Navy JAGs LT Kevin Shea and LT Kristen Anastos have been detailed as Petty Officer McCabe’s military defense counsel and are working diligently to prepare for trial.

    All of this is ridiculous. Charges brought on by a murdering terrorist with a fat lip. The Navy brass should be ashamed to even pursue such a waste of time, money and effort. The only real winners here are the terrorists. While this administration and it’s so called military leaders drag this show trial out, three highly experienced operators are not out in the field protecting the people of our great nation from the likes of Ahmed Hashim Abed. That is the real crime here. They should be trying the Admirals and the CIC for aiding and abetting the enemy. These three SEALs deserve to be awarded medals for capturing that terrorist war criminal Ahmed Hashim Abed.

    I know the military has different court proceedures than civillians, but to detain an American citizen without producing even “Probable Cause” is tantamount to Communism or even the 3rd Reich.

Beat him to a pukp for all I care, just leave these HONORABLE Seals alone & give them a medal for taking him alive.

    These honorable Seals deserve better treatment than this.
    What they and their families are going through over a terrorist with a split lip is not acceptable.
    The leadership, sitting behind desks, must realise the injustice and do the “RIGHT” thing.

    Absolutely absurd! These heroes should be immediately set free and relieved of any culpability as to the alleged harm done to a terrorist. What in the hell can our military leaders including the Commander in Chief be thinking??? Let’s get these Seals exonerated immediately and try the brass who charged them or led to them being charged. Those responsible for this travesty should be jailed and serve hard time immediately.

    We all know who is behind this- the White House! It is retaliation for the Seals taking out the pirates several months ago without proper “authorization” from our joke of a president. Shame on all of them in D.C. They are not fit to run our great country.

    The Navy brass shouldn’t just be ashamed — they should be prosecuted. These cases are providing aid and comfort to the enemy. The Navy administrative personnel responsible are committing something bordering on treason. The three SEALs should be freed from this immediately, but charges should be brought against all those up and down the line who brought these cases and approved of them. Let’s fight fire with fire.

    These 3 men have every right to turn down an unjust Article 15 from their unjust commander. They have every right to demand trial.

    I’m one of the few people on this planet who has had the distinct pleasure of turning down an unjust Article 15 and demanding trial. I’m glad I did it and I don’t regret it at all. I lost nothing. I walked with my rank and money and retired after 24 years of service. I continue to severely damage the reputation of the US Air Force—-and news events like Major Jill Metzger and Major Abu Nidal Hassan prove me and these 3 Navy SEALS right—-WE ARENT GOING TO TAKE ANY BS FROM YOU AND WE WILL FIGHT YOU—WE WILL CONTINUE TO PUBLICIZE AND CONDEMN WHAT WE KNOW TO BE WRONG!

    This absurdity is yet another shining example of how Political Correctness is ruining our country.

    Every single military person who has anything at all to do with these fine SEAL’s arrest, trial, etc., should be strung up without a trial. Hell, they don’t need a trial. The proof is already evident to all. This includes the Commander-in-Chief who very easily could end this debacle. Except he won’t because those SEALs fight on the side of his enemy; the United States of America!

    Please tell me I’m missing reams of very important information. Please tell me the case against these Seals is more than a punch in the stomach and a fat lip. Otherwise, senior military officials in charge of these proceedings should quickly extracate their heads from the sand (and other places) and earn their pay by acting like, or at least pretending to be, military leaders.

    Your failure to stop this speaks volumes about your leadership. If you fail to recognize these men as brave soldiers who do what few would dare, please resign your post immediately. In a time of war we do not need military leaders who can not stand tough with the soldiers who risked their lives to carry out the mission.

    What’s a seal to gain by risking his life to bringing in the bad guy only to risk his freedom by an accusation.
    Besides, our CINC’s idea of interogation is to “ask twice”.

    It seems to me that if three Navy SEALS were to “abuse” a terrorist that they would (1) NOT leave any visible evidence; (2) make sure the evidence was a lot worse than a fat lip; or (3) hide the body really well when they were done. I guess they should have taken option #3 instead of the honest approach of turning him in. This is the most embarrassing military prosecution I have ever heard of.

    I agree with all of the above. Further, This is happening because of the power from the top, e.i. Mr. Obama. This is his mind-set. Protect the enemy at all cost. Bring them to NY for trial and treat them like US citizens, no matter the cost or danger he is inflicting on the people of NY. Take the name “terrorist” out of government communications. “Don’t jump to conclusions that the Fort Hood incident is a terrist act.” Tie the hands of those who extract information from our enemys that saves American lives. Be nice to our enemies and they will be nice to us. The murdering animal complains of an ouee and they put our protectors of freedom on trial. We need to work hard to vote out this administration, this Attorny General, Eric Holder, the czars, and the administration supporters. I am not saying to vote in the Republicans. We need to take a hard look at the people we vote for, look at who they associate with, look at their voting record.

    As a former Special Forces Green Beret member – 10th Special Forces, This is APPALLING !! What in the world has this nation become. 58,000 plus soldiers killed in Vietnam because of Political B.S. and no discipline. Now we have the best trained Military and Special Forces ever and in the world. You want to court martial these Navy Seals for doing a Super job because of what came out of the mouth of a Murderous Thug who killed our soldiers? General(s) YOU SIR(S) need to be court martial ed. And the Liberal President Obama IMPEACHED as commander in chief.

    How Ridiculous!!
    As a Marine (we never retire) these great men were just doing what any TRUE American would. They captured the bad guy, and brought him in. This is purely a representation of the political corruption in this country and goes to show how a “pacifist” administration, such as we have now, we go to any lengths to give our great power away.
    They should be ashamed of themselves and I don’t have any idea how they can show their faces in this country!

    I viewed the photo’s of two of the Blackhawk Security Men’s lifeless bodies as they hung from that brigde. I viewed the angry crowd that surrounded them, and I think about our Brave Men & Women in the US Military who voluntarily signed up, to fight and defend those who cannot defend themselves and for all of those brave Men & Women I say…Shame on those who are seeking to discredit our fighting forces. My prayers are with all, God Bless the NAVY SEALS!

    How can our military seek to punish our brave volunteers who went through extensive training and also are the bravest in the military for doing their duty to God and country? I have been on this earth 69yrs. i have been through 4 wars and have never ever seen anything like this..i had loved ones in viet nam and that was a useless war…my brother wanted to be a navy seal in nam but he was only 17 and my mother would not give her permission..so he was in the 7th feet..what is wrong with this country and its leader , that they want to bow down the the enemies? and our navy seals are being discredited for the hard work they do..why is the enemy being protected? that is SICK i cant imagine going against our own seals for a piece of garbabe that the seal should have killed but they didnt if i were one of them he would have died on the spot. COULD YOU PLEAS TELL ME WHO DETERMINES WHAT HAPPENS TO THESE BRAVE MEN? OUR LEAD? THE GOVERNMENT? or THE MILITARY? I DOUBT ITS THE militaray .so who does that leave? P.S dont forget that we still have a constitution (I hope) and freedom of speech (i hope).the way things are going it sure doesnt look like it..

    How in good conscience can you let this court martial take place?? But not only is this plain wrong; you are also making a mockery of us in the eyes or rest of the world! We are court marshaling the best of the best because of the word of a savage??!! Why are you willingly participating in this unconscionable treasonous act?? It is your job to defend us, and it is not your job to destroy the lives of our children who put their lives on the line for our freedom and safety; but this is exactly what you are doing, and it is treasonous.     This should not be an issue. How many of our troops who were POW’s in the past were subjected to much worse conditions, Ahmed Hashim Abed should Praise Allah for his not getting a worse beating while/when resisting capture and/or taunting his captors. A split lip is the least of his worries, You, Adm.Gary Roughead, did not get your rank from being soft and mollycoddling the enemy, If you Sir cannot stand behind our/your troops you should be demoted and made to stand before them in the line of fire. Have you sat in your Over-stuffed Pentagon chair too long, and forgotten what it means to be on the Front-Lines?
    Our fighting forces are the best trained in the world, They would got to “Hell & Back” defending this Great Nation of ours, You sir, should be willing to do no-less for them. I am asking you to dismiss all charges and to Honor them (while apologizing) with your most humble respects, to them for doing their jobs.
    Maybe you are getting to old for the position you hold, are you suffering from some form of Dementia or something else? Did you forget that Abed is part of the same enemy that flew an airliner into the “Pentagon” your office building and killed many of your/our people,

    On January 18th, 2009 The State of South Carolina House of Representatives passed a “Resolution” in support of these Seals so this case can be dismissed and these operators can continue active duty. I requested the state, Rep. Bill Herbkersman to bring before the House on this day a request for the State to support our Navy Seals in this matter and in general for the citizens of the state. I am pleased to be informed by Mr. Herbkersman that original legistration is being sent to The President and Congress this week and to me for this effort. My entire family is able to exist because of our military, we all have served honorbly and understand the sacrifices necessary for our country to remain free.     Release the Seals and stop aiding and abetting the enemy!
    This is a traitorous move on the part of all who are pushing
    for court-martial. You take the best our nation has and
    try to punish them because of some politically-correct intent. I would have liked to have punched Ahmed myself.
    I know of the cruelty of the Blackwater deaths and how the
    crowd of Muslim devils danced and laughed for joy.
    Release our Seals And leave their records clear. I resent

    It is unconscionable that we would ask these courageous Seals to do such dangerous work and then prosecute them for the task we gave them. Mr. Obama has said that we should stand on higher ground and not lower ourselves to what these terrorists are doing. We already are standing on higher ground. They captured this cruel terrorist alive, no worse for the wear. Mr. Obama and the rest of us sleep safely in our beds while these brave Seals do dangerous work in the night. We, the United States of America, have become weak. We are so busy beating up our courageous heroes for minor infractions that we are disabling them. How dare we ask these or any of our brave patriots to defend us and rid us of evil when all we do beat them down with our arm-chair quarterbacking from the safety of our home or office. The prosecution and the Commander-in-Chief should apologize to these Seals and to the American people.
